The New York State Trial Lawyers Association has posted this article on New York’s Scaffold Law. The article offers an accurate discussion about the needs for Labor Law section 240(1), especially among the Latino community; however, the article’s statement that pending legislation would result in more accidents is misleading. The legislation to amend the Labor Law has attempted to add a comparative negligence aspect to the existing statute (see this summary on the Business Council of New York State). Such a change would hardly appear to cause more accidents.
