This post is a continuation of “New York Civil Law’s” coverage of interesting upcoming issues coming before the New York Court of Appeals. The Court will hear arguments on Greenberg v. Sir-Tech Software out of the Appellate Division, Third Department, this upcoming 2004-2005 Term. This contract case involves the doctrine of “law of the case” and procedural issues concerning the interplay between appeals and amended complaints. The Third Department memorandum was terse so it will be interesting to read the Court’s decision on this matter.
