The New York Court of Appeals accepted the three certified questions from the United States Court of Appeals for the Second Circuit in Capital Records, Inc. v. Naxos America, Inc. The issues relate to common law copyright of recordings made prior to February 15, 1972. Sanford over at Second Opinions blogged about the certified questions a couple of weeks ago.
