The New York Court of Appeals will hear oral arguments this Tuesday on certified questions from the United States Court of Appeals for the Second Circuit on issues concerning attorney’s fees for insureds within the context of defending a declaratory judgment action.  I wrote about this case — U.S. Underwriters v.
