New York Court of Appeals Will Hear Issue Whether Federal Law Preempts A State Claim for Harrassment of Broker on Floor of American Stock Exchange

The New York Court of Appeals granted leave to appeal on an extremely interesting issue concerning whether federal law preempts a state harassment claim against the American Stock Exchange.    The plaintiff, a broker who traded on the AMEX floor, claimed that she was harassed by a fellow trader, who was a member of AMEX.

The case is Bantum v. Am. Stock Exch., and the Appellate Division, Second Department dismissed the plaintiff’s complaint against AMEX based on its understanding of the applicable federal regulations.
