In all my excitement over the New York Court of Appeals’ decisions in Argo Corp. v. Greater New York Mut. Ins. and Rekemeyer v. State Farm Mut. Auto. Ins. Co., I forgot to report that New York State Senator Bonacic has proposed S1770 (see link for full text of proposed bill).  This bill seeks to amend the Insurance Law to require a prejudice showing where insurers disclaim on untimely notice. 

Ironically, Senator Bonacic introduced the bill exactly one week before oral arguments at the Court of Appeals on Argo Corp. and Rekemeyer (see prior post).
