New York Court of Appeals Hands Down Recent Decision on New York’s Long-Arm Jurisdiction Statute

In Johnson v. Ward, the New York Court of Appeals recently discussed whether long-arm jurisdiction exists over a nonresident holding a New York driver’s license and car registration for a tort claim arising from an out-of-state motor vehicle accident.  The Court held that no nexus existed between the plaintiff’s personal-injury and the defendant’s "transaction" of business within the state, rejecting the plaintiff’s argument that the defendant’s contacts with New York satisfied the two-part test under CPLR 302(a)(1).  Here is the underlying decision by the Appellate Division, First Department.
