Governor Pataki has designated Justice Henry Scudder as the new Presiding Justice of the Appellate Division, Fourth Department (see article in Buffalo Business First).  The position opened up after the Governor appointed Judge Pigott to the New York Court of Appeals.

Ironically, Justice Scudder only got 5.6% of your vote in NYCL’s Vizu poll (see here).
